Instructions for Dispute Resolution
Disputes may arise related to the competitive provision of energy services that require Commission intervention.
Part V of the Commission's Rules of Practice and Procedure defines the Commission's role in dispute resolution.
Rule 5:1 states, in part, that "Whenever practicable, informal proceedings are recommended for expeditious adjustment
of complaints of violations of statute, rule or regulation…"
In summary, an informal complaint may be initiated by letter and resolved without formal order or hearing.
The appropriate Division of the Commission or Commissioner will review the facts of the complaint and assist
with its resolution.
A formal proceeding to resolve a complaint can be initiated by an aggrieved party or by the Commission
upon its own motion. In that case, the Commission will issue a rule to show cause or other appropriate order
to set a formal hearing regarding the dispute.
